Things are always changing in the employment law area. New statutes continue to be passed by Congress and state legislatures on an ongoing basis. More often, practitioners have to deal with changes developed by federal and state enforcement agencies such as the Equal Employment Opportunity Commission. To make things more interesting (difficult?), a United States Supreme Court case from 2024 will significantly impact how courts use regulations in making rulings in many cases. In the past, courts were obligated to defer to agency regulations, unless the regulation was written in a manner beyond the agency’s authority. Now, they have greater latitude to disregard the regulation and interpret the relevant statute as they choose. Along with these ongoing changes, all of use are still following the effect of the new administration’s agenda which is being implemented within the first one hundred days and those that follow.
